Description

ARTERBURN, J. ON PETITION FOR REHEARING - Appellant complains on petition for rehearing that we failed to dispose of a point raised by him, namely, the claimed error in the introduction of State's exhibit 4, which consists of a brief statement to the effect that ""I lost my temper"" when he struck his daughter. We think this point is well disposed of in Judge Mote's Dissenting opinion, in which it is stated that the trial court heard evidence which was conflicting with reference to whether appellant had been advised as to his constitutional rights, and found that there was no such violation. The petition for rehearing is overruled.
